Under the Family Law Act 1975, the grounds for divorce in Lake Macquarie is the irretrievable breakdown of the marriage, which can be proven by one of the following: 12 months separation with the consent of both parties, or without consent if certain conditions are met; or Adultery; or Unreasonable behaviour.
The best interests of the child are the paramount consideration in determining child custody in Lake Macquarie.
The court will consider a range of factors including the child’s relationship with each parent, the child’s emotional, social and educational needs, the capacity of each parent to provide for those needs, and any other relevant matter.
