Grounds for divorce in New Castle include adultery, cruelty, desertion, imprisonment, and separation for a certain period of time.
Additionally, a no-fault divorce option is available where the parties have been living separately for at least one year and there is no reasonable prospect of reconciliation.
Child custody in New Castle is determined based on the best interests of the child. Factors that are considered include the child’s relationship with each parent, each parent’s ability to provide for the child, and the child’s own preferences (if old enough to express them). To obtain a restraining order in New Castle, an individual must file a complaint with the court. The court will then hold a hearing to determine whether a restraining order is necessary.
